in the united states we have the best protections for the accused of anywhere in the world, and this is a good thing, because our system errs on letting the accused go even if there's decent evidence they did it, rather than locking them up unjustly. but foreign enemy combatants don't deserve the same protections as our citizens, and you're not going to win a war by giving them these protections.
